RENTAL TERMS AND CONDITIONS – MB DREAM LIVING

Thank you for your interest in staying at a property managed by Marbella Banús.
To ensure a pleasant and trouble-free stay, it is essential that all our guests read and understand the following conditions,
which apply to all bookings made through our agency or via partner platforms.


1. The Contract

The vacation rental contract is established between the client (individual or legal entity) and Marbella Banús – Garu Ventas y Alquileres SLU.
This contract takes effect once the booking has been confirmed in the system and the payment conditions have been met:

  • 50% of the total amount upon booking confirmation
  • Remaining 50% 30 days before check-in

If the booking is made through platforms such as Booking.com, Airbnb, etc., the payment conditions of those platforms will apply.

This contract is governed by Spanish law, and in case of dispute, both parties expressly submit to the jurisdiction of the courts of Marbella, waiving any other jurisdiction.


2. Payment Conditions

  • Timely payment is essential to maintain the reservation.
  • If the second payment is not made within the established period, the reservation will be automatically canceled without refund of amounts already paid.
  • Partial payments or deferrals are not accepted without written authorization.


3. Cancellation / Changes / Refunds

By the client:

  • More than 60 days before arrival: full refund minus 2% administrative fee
  • 59 to 30 days before arrival: 50% of the total amount is non-refundable
  • Less than 30 days before arrival: rental not refundable; cleaning and extras refundable if no costs incurred

Name changes are accepted if notified at least 48h in advance, provided dates, conditions, and rates remain the same.

By MB Dream Living:

If, due to force majeure or reasons beyond our control, the booking cannot be fulfilled, we will offer an alternative of equal or higher quality.
If not accepted, the full amount paid will be refunded.


4. The Property

All photos, descriptions, and amenities on our website accurately reflect the property. However, minor non-substantial changes (e.g., replacement of an appliance) may occur and do not constitute grounds for complaint or compensation.


5. Maximum Occupancy and Access Rules

  • Each property has a maximum legal occupancy that must be respected at all times.
  • Anyone not included in the booking must be registered in advance.
  • Exceeding the limit without authorization will result in immediate eviction without refund.
  • If the actual number of occupants exceeds the booked number but is within the legal limit, it must be reported at least 24h before arrival. Otherwise, a penalty of €50 per person per night applies.


6. Pets

  • No animals are allowed in any of our properties unless expressly authorized in writing.
  • Any unauthorized pet detected will result in immediate eviction without refund.
  • No excuses such as “it’s small”, “doesn’t bark” or “doesn’t make a mess” are accepted.


7. Check-in and Check-out Times

  • Standard check-in: 16:00 to 21:00
  • Check-out: before 11:00
  • Arrivals outside these hours: key collection from the secure box at the central office
  • Early check-in before 16:00 and late check-out after 11:00 can only be confirmed the same day, subject to availability.
  • Unauthorized late check-out: €50 + VAT per hour (fractions charged as full hour)
  • Entry to the property while cleaning staff is working is not allowed.


8. Responsible Use and Coexistence

  • Hold unauthorized parties, events, or gatherings is forbidden
  • Disturb neighbors with loud music, especially at night
  • Smoking inside the property is prohibited
  • Use nitrous oxide (laughing gas). Capsules found will be charged €50 each
  • Any complaints from neighbors or violations will result in immediate eviction without refund or deposit return


9. Keys and Access Management

  • Two sets of keys are provided per booking. Responsible management is the guest’s obligation.
  • Loss or failure to hand over at the agreed location: €200 + VAT (includes lock change for security)
  • Keys left inside the property: after hours, guest must call a locksmith and cover the cost; during office hours, Marbella Banús can assist for €100


10. Bed Linen and Towels

  • Included in the booking: one set of sheets per bed, duvet cover, pillow and protectors, one set of towels per person
  • All items must be returned in good condition. Any damage, stain, or deterioration beyond reasonable wear will be charged to the guest.


11. Cleaning and Check-out

  • Ensure all electrical appliances are switched off and rooms ventilated
  • Close doors and windows properly
  • Do not leave trash; if found, a €200 + VAT fee applies
  • Follow the instructions sent by email 48h before departure for key handover


12. Right of Entry

Marbella Banús may access the property with at least 24h notice, except in justified emergencies such as water leaks, electrical failures, or security reasons.


13. Lost Items

We are not responsible for items left behind in the property. In case of loss, contact us as soon as possible and we will do our best to recover them.


14. Security Deposit

An amount will be blocked on your credit card the day before arrival, to be returned within 7 days after departure, provided no damage is found.
This block is managed via Stripe, and for stays longer than 7 days, it will be automatically renewed.


15. Complaints

Official complaint forms are available. To request them, simply contact our team.


16. Insurance

Marbella Banús acts as an intermediary agency. We do not own the properties.
It is recommended to purchase travel insurance covering cancellations, medical emergencies, theft, or personal damage.
